2. Definitions

• Agreement — this agreement for providing the Service, concluded online between the Company and the Client.
• Client / user / you — a user of the Company's Service.
• Company — Growth Labs Inc., registered at #314 - 222 Baseline Rd, Box 129, Sherwood Park, Alberta T8H 1S8, Canada.
• Privacy Policy — the Company's privacy policy published on the Service.
• Service / Products — the digital content and digital services available through the Service, including the personality assessment, your personalized profile and results, and the membership (daily practices, growth program, journaling and progress tracking, and related content). Products may be free or paid. Availability may vary by country and language.
• Subscription — a plan under which the Client is billed on a recurring basis for access to the Service.
• Distance contract — a contract concluded between the Company and the Client through the Company's online system.

3. Changes to these Terms

The Company may modify or update this Agreement from time to time. Changes are effective upon posting to the Service.

We may notify you of material changes by email to the address you provided or through the Service.

Your continued use of the Service after changes are posted means you agree to the updated Agreement. If you do not agree, you must stop using the Service.

4. Eligibility

The Service is intended for users who are 18 years of age or older. By using the Service, you represent that you are at least 18 and that the information you provide (including your age) is accurate and complete.

5. Accounts

To access the membership, you create an account and provide accurate, current, and complete information.

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us promptly of any unauthorized use.

If we discover or believe that information you provided is inaccurate, outdated, or incomplete, we may suspend or terminate your access at our discretion.

6. The Service

The Service offers a personality assessment and a personal-development membership. Based on your responses to the assessment questionnaire, our software generates a personality profile and type using an interpretive framework, and provides related membership content. All products are digital; no physical goods are delivered. Access is provided through the Service and the email address you provide.

We may offer optional add-on or upgrade products from time to time, which you may choose to purchase at or after checkout.

Available products and features may vary by region.

7. Not professional advice

The Service, including your personality assessment, profile, type, and all practices, programs, and content, is provided for informational and self-improvement purposes only.

The Service is not medical, psychological, psychiatric, or other professional advice, diagnosis, or treatment, and is not a substitute for professional care. Do not disregard or delay seeking professional advice because of anything you read in the Service. If you are experiencing a mental health crisis or emergency, contact a qualified professional or your local emergency services.

Your personality type and results are based on your self-reported answers interpreted through a personality framework (the Enneagram). They are not a clinical or scientific assessment, and we make no representation that they are diagnostically accurate.

8. Orders, payments, trial, and subscription

To purchase, you complete the assessment, select a plan, and provide a valid payment method. You agree to pay all applicable fees, charges, and taxes.

Trial. When you start your trial, you authorize us to charge a one-time fee of US $1.00 to your payment method for a 7-day trial period that gives you full access to the membership.

Automatic conversion and recurring billing. Unless you cancel before your 7-day trial ends, your paid subscription begins automatically and we charge US $30.00 (plus any applicable taxes) to your payment method. Your subscription then automatically renews every month, and we charge US $30.00 (or the then-current price) to your payment method at the start of each monthly billing period, until you cancel. By starting your trial, you authorize these recurring charges.

Price changes. We may change subscription prices. We will give you notice before a changed price applies to you. Your continued use after a price change takes effect means you accept the new price.

Billing descriptor. Charges will appear on your statement as "Personality Profile," "personality-profile.com," or "support@personality-profile.com."

Payment processing. Your payments are handled by a third-party payment processor over a secure, encrypted connection. We do not store your full payment card details. We are not liable for issues or disputes arising from the third-party payment processor, and we may change processors from time to time.

Currency. All prices are in US Dollars unless otherwise indicated. The price applicable is the one shown at the time you place your order, and all fees are disclosed before you confirm your purchase.

One-time purchases. Where we offer a product for a single, non-recurring payment, we disclose the price and any ongoing fees before you buy.

9. Cancellation

You may cancel your subscription at any time by logging into your account and selecting "Cancel subscription," or by contacting us at support@personality-profile.com.

To avoid being charged the subscription fee, cancel before your 7-day trial ends. To avoid a future monthly charge, cancel before your current billing period ends.

Cancellations made through your account take effect immediately for future billing; cancellation requests sent to support are processed within 72 hours of receipt. When you cancel, your access remains active until the end of the current paid period, after which it ends.

If you purchased your subscription through the Apple App Store or Google Play, you must manage and cancel it through your Apple or Google account; deleting the app does not cancel the subscription.

10. Refund policy

The US $1.00 trial fee is non-refundable.

You may request a refund of your first monthly subscription charge within 14 days of that charge by contacting support@personality-profile.com. All subsequent monthly charges, and any one-time purchases, are non-refundable.

Approved refunds are issued to the original payment method and may take up to 14 business days to reach your account. By purchasing, you agree to this refund policy.

11. Acceptable use

You agree not to: misuse the Service; share, resell, or distribute the content; reverse-engineer or copy the Service; access it through unauthorized means; or use it for any unlawful purpose. We may suspend or terminate access for violations.

12. Intellectual property

All content and materials in the Service, including the assessment, profiles, text, design, and software, are owned by the Company or its licensors and are protected by intellectual property laws. We grant you a limited, personal, non-transferable, non-exclusive license to access and use the Service for your own personal use. No other rights are granted.

13. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that results will meet your expectations.

14. Limitation of liability

To the maximum extent permitted by law, the Company will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of or inability to use the Service. To the maximum extent permitted by law, our total liability for any claim relating to the Service will not exceed the amount you paid us in the 12 months before the claim arose.

15. Indemnification

You agree to indemnify and hold harmless the Company and its officers, directors, and employees from any claims, damages, or expenses arising from your use of the Service or your breach of this Agreement.

16. Termination

We may suspend or terminate your access to the Service at any time for breach of this Agreement or for any conduct we reasonably believe is harmful to the Service or other users. You may stop using the Service at any time by cancelling your subscription and closing your account.

17. Privacy

Your use of the Service is also governed by our Privacy Policy, which explains how we collect and handle your personal data.

18. Governing law and disputes

This Agreement is governed by and construed in accordance with the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to conflict-of-laws principles. You agree that the courts located in Alberta, Canada will have jurisdiction over any dispute arising from this Agreement, subject to any mandatory consumer-protection rights available to you in your place of residence.

19. Miscellaneous

Severability. If any provision of this Agreement is found unenforceable, the remaining provisions remain in effect.

Entire agreement. This Agreement and the Privacy Policy constitute the entire agreement between you and the Company regarding the Service.

Assignment. You may not assign your rights under this Agreement. We may assign ours in connection with a merger, acquisition, or sale of assets.

Force majeure. We are not liable for any failure or delay caused by events beyond our reasonable control.

20. Minors

The Service is not intended for anyone under 18. If you believe a minor has provided us information, contact support@personality-profile.com. You are responsible for ensuring the information you provide (including your age) is accurate and complete.
